1. Acceptance of Terms

By creating an account or using the Flailo service ("Service") at flailo.com, you ("User") agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms constitute a binding legal agreement between you and Flailo ("Company", "we", "us").

2. Description of Service

Flailo is an AI-powered cold email personalization tool. It uses artificial intelligence to generate personalized cold email copy based on information you provide about your product and the target company. The Service is provided on a subscription basis with monthly usage limits based on your plan.

3. Acceptable Use

You agree that you will not use the Service to:

  • Send unsolicited bulk email (spam) in violation of applicable laws including CAN-SPAM, GDPR, or CASL
  • Generate or send emails that are deceptive, fraudulent, or misleading
  • Harass, threaten, or abuse recipients
  • Generate content that is illegal, defamatory, or violates any third-party rights
  • Attempt to bypass usage limits or access controls
  • Resell or redistribute the generated content as an AI writing service
  • Use the service for any unlawful purpose

Violation of this section may result in immediate account termination without refund.

4. Payment Terms

  • Subscription: Paid plans are billed monthly in advance. Your subscription renews automatically on the same day each month.
  • Free plan: The Starter plan includes 50 emails/month at no charge. No credit card required.
  • Pricing: Current prices are listed at flailo.com. We reserve the right to change prices with 30 days' notice.
  • Refunds: We offer a full refund within 7 days of your first paid subscription. After 7 days, no refunds are issued for the current billing period.
  • Taxes: Prices are exclusive of applicable taxes. You are responsible for any taxes imposed on your use of the Service.

5. Cancellation Policy

You may cancel your subscription at any time from the Billing tab in Settings. Cancellation takes effect at the end of your current billing period — you retain full access until then. After cancellation, your account reverts to the free Starter plan. We do not offer prorated refunds for unused time.

6. Intellectual Property

Your content: You retain ownership of all input data you provide and the emails generated for you. By using the Service, you grant us a limited license to process your inputs to provide the Service.

Our platform: The Flailo name, logo, website, and underlying software are owned by us and protected by intellectual property law. You may not copy, modify, or distribute any part of our platform without written permission.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without any warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated content will be accurate or suitable for any particular purpose. You are solely responsible for reviewing and approving any email before sending it.

8. Limitation of Liability

To the maximum extent permitted by law, Flailo shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of business, loss of revenue, or reputational damage resulting from emails generated or sent using our platform. Our total liability to you shall not exceed the amount you paid to us in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Flailo and its officers, employees, and agents from any claims, liabilities, damages, and expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

10. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, suspected fraud, or for any other reason with or without notice. Upon termination, your right to use the Service ceases immediately.

11. Changes to Terms

We may modify these Terms at any time. We will notify you by email or in-app notification at least 14 days before material changes take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration unless prohibited by applicable law.
